Octuspay is an online platform that allows you to easily, securely, and quality create, sell, and promote your digital products. It also allows you to become an affiliate and earn money by promoting the products of other producers.

To access and use the platform, you need to accept all the terms and conditions described below.

It's important that you carefully read these Terms and Conditions of Use before using the service.

These Terms and Conditions are the rules for using the Octuspay platform.

To establish clear and efficient communication, Octuspay specifies the key terms and concepts that users must understand for better use of our platform.

CONCEPTS:

OCTUSPAY PLATFORM: an online platform used for managing and selling digital products (INFO PRODUCTS), designed to digitally connect customers, affiliates, and producers, offering content, solutions, and technological tools.

CONTENT: digital materials created by a Producer registered on the Octuspay platform or authorized for exclusive linkage by another person, such as video, audio, text, software, service, and events, within the Octuspay Platform.

USER: a person who accesses, registers, and/or navigates on the Octuspay Platform, qualifying as a producer, affiliate, or buyer.

PRODUCER: the legal owner of one or more contents available within the Octuspay platform, whether the main author or the owner of a valid authorization for online content linkage, with direct access to the platform and Octuspay tools.

AFFILIATE: a person who registers on the platform to contribute to the commercialization of contents provided by Producers through commissioning. The Affiliate is remunerated according to the Octuspay Affiliate Program Terms and the rules contracted directly with the Producer, entered on the Octuspay Platform.

BUYER: a person who acquires contents available on the Octuspay Platform.

2. GENERAL CONSIDERATIONS: ABOUT THE OCTUSPAY SYSTEM

2.1 Users must use the Platform responsibly! This means that activities carried out within octuspay.com must be within what is morally permissible. We do not accept the publication or dissemination of defamatory, obscene, or illegal content. We also do not allow information about individuals, companies, or brands protected by unauthorized copyrights. It is strictly prohibited to use the Platform to disclose personal information about users.

2.2 Octuspay undertakes to preserve the authenticity of the information stored on the Platform, but its creators and contributors are not responsible for any failures in services/tools or additional information offered. This means that the user must understand that the Platform is not error-prone and does not adapt to individual objectives, so we remind you that the Terms and Conditions of Use or prices can be changed at any time.

2.3 The legal representatives of Octuspay, if they deem it necessary, may modify or deactivate the Platform, even cancel, limit, or suspend the use/access of some users. Therefore, it is very important that you constantly visit the Terms of Use of the Platform, as they may be changed or replaced by other terms or legal notices.

2.4 By registering on the Platform, the user declares that they are aware of, understand, and agree to the Terms of Use provided, as well as the Privacy and Copyright Policies. If the user disobeys any of these rules, they may automatically lose access or have their account canceled, in addition to the immediate breach of the Octuspay Platform usage license.

3. LICENSE GRANTED TO USERS

3.1 From the first access and registration on the Platform, Octuspay grants USERS a non-exclusive, temporary, non-transferable, and revocable license to use the Platform.

3.2 Users acknowledge that any unauthorized copying or use of the Platform or the content made available within the Platform may violate intellectual property rights, including copyrights and trademarks, and the Terms of Use and Privacy Policy.

3.3 Users are authorized to access and use the content and tools available on the Platform solely for personal use, and the commercialization or licensing of the content of the Platform or any use that is not in compliance with these Terms is strictly prohibited.

4. USER REGISTRATION

4.1 Octuspay's services are available only to people who are over 18 years of age and able to sign legally binding contracts. Users under 18 years of age are prohibited from registering. By registering, the user declares that they are of legal age to be part of this agreement and to use the Platform according to the described rules.

4.2 The user undertakes to provide truthful information when completing their registration, as well as keeping this information up to date. Octuspay is not responsible for the accuracy of the data provided by users.

4.3 Octuspay reserves the right to use all legal means to verify the identity and information provided by the user, and may cancel the registration if there is any suspicion of false, inaccurate, outdated, or incomplete data.

4.4 In addition to the information required for registration, the user may be asked for additional data and documents to guarantee their authenticity, for reasons of fraud prevention and data accuracy.

4.5 If the user's registration information is found to be false or out of date, or if the user has difficulties in providing authenticating documents, Octuspay may suspend or cancel the account, and the user may be banned from any future registration on the Platform.

4.6 In the event that the registration data is proven to be false, or if there is a complaint from another user, Octuspay may request additional information and documents from the user, including but not limited to: proof of address, identity document, photographs, etc. The user has a deadline defined by Octuspay to provide these documents, and the user may be prevented from using the Platform until they provide the requested documents.

4.7 The user is responsible for the security of their login and password, and in case of unauthorized access, the user must inform Octuspay immediately. The user is responsible for all activities that occur on their account. In cases of unauthorized access, Octuspay will provide the user with assistance for the recovery of their account, which is not guaranteed.

4.8 Octuspay may use email or the Platform to communicate with the user. It is the user's responsibility to keep their contact email and other information up to date.

5. CONTENT PUBLICATION

5.1 The user declares that they are the legitimate owner or authorized by the owner of the rights to use, reproduce, exhibit, and distribute the content made available on the Platform. In cases where the content is owned by another person, the user must present a valid authorization form, in addition to all the necessary licenses.

5.2 The user is responsible for the information, data, text, software, music, sound, photographs, graphics, videos, messages, and any other content made available on the Platform or disclosed on the Platform. The user agrees that under no circumstances will Octuspay be liable for any content errors or omissions.

5.3 Octuspay does not guarantee the accuracy, integrity, or quality of the content made available on the Platform. It is the responsibility of the user to make sure that the information is accurate and meets their needs, before relying on it.

5.4 The user is aware and agrees that it is forbidden to use the Platform for illegal purposes, such as hosting or disseminating content that is pornographic, abusive, defamatory, or any other content that violates local or international laws. The user is responsible for any legal actions or penalties for the dissemination of prohibited content.

5.5 The user is responsible for keeping backups of their content and for any loss or damage to the content made available on the Platform.

5.6 Octuspay reserves the right to remove any content made available on the Platform without prior notice, when it deems necessary, such as for legal or technical reasons, maintenance, or when the content violates the rules established in these Terms.

5.7 Octuspay does not guarantee the preservation of stored content on the Platform, so the user is responsible for saving and backing up their content.

5.8 The user understands and agrees that they may be held responsible for the content made available on the Platform and may be subject to applicable laws.

6. AFFILIATE'S PERFORMANCE CRITERIA ON THE OCTUSPAY PLATFORM

6.1 By accepting to work with affiliates, the producer agrees to the Affiliate Program Terms.

6.2 The Octuspay Platform will process affiliate commission payments according to the terms set by the producer on the platform, as well as in the Affiliate Program Terms.

6.3 In case of issues with commission payments or if an affiliate feels disadvantaged, Octuspay may suspend the producer's and the affiliate's accounts (registrations) until the matter is resolved.

6.4 An affiliate registered on the platform must follow these steps to promote and share Octuspay's content:
I - The user must register with Octuspay as an affiliate, taking responsibility for using the available tools appropriately, following the Platform's Terms of Use and the Affiliate Program Terms. If in doubt, they should seek solutions within the platform itself.
II - The affiliate must accept, agree to, and respect all the Platform's Terms of Use and Policies.
III - The affiliate should correctly use the platform to apply for the promotion of content with the producer.
IV - The affiliate must understand and accept the rules for commission sharing established by the producer and indicated on the platform, as the producer is solely responsible for defining these details and changing the criteria when necessary without prior notice.
V - The affiliate must use the platform properly, allowing tracking of their content promotion work, always following the Platform's Terms of Use and Policy.
VI - The affiliate is responsible for disseminating accurate sales information and conditions about the offered content to the buyer, as previously established by the producer.
VII - The affiliate must agree to the rule that the sales values made using Octuspay's platform tools will generate commissions paid only after the transaction is completed and the buyer has made the payment, subject to platform authorization.
VIII - Accept receiving their commissions exclusively through integrated Checkouts with Octuspay, following the rules set by the Platform.
IX - The affiliate is responsible for platform tool-related fees, as well as for complying with their legal, regulatory, tax, and fiscal obligations.

7. INCORRECT DATA ON THE PLATFORM

7.1 Octuspay is not responsible for documents, information, data, images, graphics, or any other material inserted on the platform by users that may contain errors.

7.2 Octuspay is not responsible for the performance results of the platform or services offered.

8. CANCELLATION OF PURCHASES AND THE "SATISFACTION GUARANTEE"

8.1 In compliance with Article 49 of the Consumer Protection Code, Law 8078/90, the buyer has a 7-day period after the purchase to request cancellation.

8.2 To request the cancellation of a purchase, the customer must contact the content producer directly.
8.3 If the buyer experiences technical difficulties with canceling their purchase within the legal timeframe mentioned in clause 8.1, they should contact Octuspay via email at: [email protected], provide purchase details, explain the reasons for cancellation, and the difficulties encountered.

8.4 After contacting the buyer, an Octuspay team will review the situation and respond to the customer within up to 3 (three) business days.

8.5 The exercise of the buyer's right to the "Satisfaction Guarantee" within 7 (seven) days will impact the compensation of the producer and affiliate, following the terms of the Affiliate Program.

9. OCTUSPAY'S RESPONSIBILITY REGARDING CONTENT PROVIDED ON THE PLATFORM BY CONTENT PRODUCERS

9.1 Octuspay is not responsible for the content of digital products and information published on its platform, as these products are authored by third parties and do not necessarily reflect the opinion of OCTUSPAY TECHNOLOGY LTD.

9.2 Users are reminded that the content inserted on the platform does not have an explicit or implicit guarantee of promotion or suitability for any specific purpose. In no case will OCTUSPAY or its collaborators be held responsible for any damages, including loss of profits, business interruption, or loss of information resulting from the use or inability to use the materials. OCTUSPAY does not guarantee the accuracy or completeness of the information, texts, graphics, links, and other material items.

9.3 Octuspay is not responsible for copyright violations resulting from information, documents, and materials published on this platform.

9.3.1 Octuspay commits to remove content from its platform as soon as it receives a formal notice of copyright infringement and, after conducting the relevant analysis of the complaint, any content that infringes third-party copyrights.

9.3.2 Octuspay reserves the right, in cases where it believes there is insufficient evidence for the immediate suspension of the contested content, to keep the content online until the appropriate internal investigation is completed.

Considering that the PLATFORM is not the creator of the CONTENT produced and published by the PRODUCER, and that there is no prior editorial control of the CONTENT, Octuspay, in accordance with applicable law, is not responsible for the CONTENT published.

9.4 It is established that USERS or third parties who believe their rights have been violated should make a report using the channels provided on the platform.

9.5 Octuspay is not responsible for the content created and provided by Producers and/or Affiliates on its platform.

9.6 Upon preventive content suspension by Octuspay, the block will typically be maintained until:
I- Octuspay confirms that the suspected act or conduct described in the irregularity notice did not constitute illegal behavior, based on Octuspay's exclusive criteria and evaluation;
II - The involved parties formalize an agreement for an amicable resolution of the matter; or
III - By judicial order or order from competent administrative authorities.

9.7 Legal determinations under item III of Clause 9.6 must contain a clear and specific identification of the content or act alleged to be infringing, allowing Octuspay to properly identify and take the required measures.

9.8 If Octuspay confirms the illegal nature of the conduct reported, the preventive block will be converted into a permanent block, and the content and/or user will be banned.

9.9 In case of remaining values (credits within the platform) to be paid, these will only be released to the rightful recipient upon a court order.

10. USER AND CONTRIBUTOR INFORMATION

10.1 Any material, information, or other communications transmitted, sent, or published on this platform will be considered non-confidential information, and any violation of the rights of their creators will not be the responsibility of Octuspay.

10.2 Users are prohibited from transmitting, exchanging, or publishing any material of an obscene, defamatory, or illegal nature on this platform, as well as texts or creations of third parties without the author's permission.

10.3 Octuspay reserves the right to restrict access to information sent by third parties to its users whenever it deems it convenient and necessary.

10.4 Octuspay may review, monitor, and/or restrict access to any area on the platform where users transmit and exchange information among themselves, including but not limited to chat rooms, message centers, or other discussion forums, and may take content offline or restrict access to any of this information or communication. Octuspay emphasizes that it is not responsible for the content of any information exchanged between users, whether lawful or unlawful.

11. TREATMENT OF MINOR'S DATA

11.1 Octuspay does not monitor the content of any other website linked to or accessed through the content provided on its platform.

11.2 Octuspay may remove or block links or redirections to other sites or services at any time.

12. COPYRIGHT AND INTELLECTUAL PROPERTY RIGHTS

12.1 The documents, content, and creations on this PLATFORM belong to their creators and contributors. The authorship of the content, materials, and images displayed on Octuspay is protected by national and international laws. Therefore, they cannot be copied, reproduced, modified, published, updated, posted, transmitted, or distributed in any way without prior written authorization from Octuspay.

12.2 The images on this PLATFORM are incorporated here for viewing purposes only and, unless explicitly permitted in writing, cannot be recorded or downloaded via download. Reproducing or storing materials obtained from this service will subject the offenders to legal penalties.

12.3 The PLATFORM's name (octuspay.com), its logo, the Internet access domain name, as well as all the characteristic elements of the technology developed and presented here in the form of database articulation, constitute registered trademarks and private intellectual properties, and all rights arising from their registration are protected by law. Some usage rights may be granted by OCTUSPAY in a contract or special license, which can be canceled at any time if its terms are not met.

12.4 OCTUSPAY's registered trademarks can only be used publicly with express permission. The use of these registered trademarks in advertising and product promotion must be properly informed.

13. RESULTS GUARANTEE

13.1 Products, content, or services sold through the Octuspay Platform should not be interpreted as a promise or guarantee of success in any way.

13.2 The results mentioned or presented in testimonials only represent the potential that can be achieved through the application of the information and methods contained in the content. There is no guarantee that similar results will be obtained.

13.3 The level of results or success obtained through the content provided by our producers depends on factors related to the effort put into applying the information, the time dedicated, how it is applied, previous experience, and individual capacity.

13.4 Since these factors vary from person to person, including cases where the content is never applied and, therefore, does not bring about any change in the buyer, it is not possible to guarantee the results that will be obtained from the acquired content. Neither OCTUSPAY nor its producers are responsible for any damage resulting from the application or use of the information presented in this content.

13.5 Even though there is no result guarantee from Octuspay, it is possible to invoke an unconditional refund guarantee as determined by law, or, if still within the time frame and within the terms of the guarantee established by the producer.

14. RECLAMAÇÕES SOBRE VIOLAÇÃO DE DIREITOS AUTORAIS

14.1 Octuspay respects the intellectual property of others, and we request our members to do the same. Any and all copyright violations should be reported to Octuspay along with the documents and information confirming authorship. The notice can be sent to the emails listed on the Platform.

14.2 Once the complaint is submitted, and within the Content warranty period, considering that the Producer remains responsible for the technical and quality aspects of the GENERATED CONTENT, Octuspay will notify the relevant Producer and grant up to 10 (ten) consecutive days for them to respond to the complaint with a justification or an attempt to resolve the issue. If the PRODUCER does not contact us within this period, the refund request may be executed automatically, and the PRODUCER's data may be provided to the BUYER, in accordance with the Privacy Policy.

14.3 If anyone believes that any CONTENT uploaded to the PLATFORM violates their industrial property rights (trademark, patent, industrial designs) or copyright, they can notify Octuspay through a request sent to customer support, indicating the URL where the relevant CONTENT is located, and attaching legally appropriate documents to prove their ownership of the CONTENT.

14.4 After internal investigation, Octuspay will formally state its position on the dispute.

15. RESTRICTIONS ON THE USE OF SERVICES AND EXPRESSLY PROHIBITED CONTENT

15.1 The User should not use Octuspay services to advertise or market the following prohibited content, under penalty of platform banning:

Products related to firearms, narcotics, illegal drugs, and any illegal substances;
Products obtained from third parties, stolen or stolen;
Counterfeit or adulterated products;
Stock exchange-traded companies;
Mailing lists or personal databases;
Products that violate the privacy, honor, image, name, or any other personal rights of third parties;
Products related to pedophilia, prostitution or similar, pornographic material containing nudity or sexual acts, or otherwise obscene or contrary to morality and good manners;
Products that promote smoking;
Products that promote pyramid schemes, multi-level marketing, etc;
Products that promise success in lotteries or gambling;
Products that promote violence and/or discrimination based on race, gender, religion, nationality, sexual orientation, or any other type;
Products that promise to cure health problems without the support of an organization recognized as specialized in the subject;
Products containing music and videos in any format when they are not expressly authorized by the artist or copyright holder;
Products that violate the intellectual property rights of third parties, such as products that violate software, copyright, patents, trademarks, models and industrial designs, licenses, academic programs and/or developed for an educational institution, or industrial secrets;
Products subject to any restriction of any kind regarding their use, exploitation, or domain transfer or possession;
Any other products the sale of which is expressly prohibited by the laws in force at the location of the transaction.

16. GENERAL USER GUIDELINES

16.1 Without prejudice to other rules provided in these Terms of Use, the User undertakes not to perform the following actions, UNDER PENALTY OF BANNING FROM THE OCTUSPAY PLATFORM:

a) copy, modify, reproduce, distribute, download, store, transmit, sell, resell, reverse engineer, or create derivative products from any content available on the PLATFORM;
b) violate or attempt to violate any security measures of the PLATFORM, or take advantage of any system inconsistency to gain an advantage for oneself or others, or cause damage to Octuspay and/or third parties, especially by accessing or attempting to access any USER account of the PLATFORM, or by obtaining and disclosing the USER's password of the PLATFORM;
c) submit false, inaccurate, or incomplete information to the PLATFORM;
d) manipulate CONTENT prices;
e) interfere with transactions between other USERS;
f) impersonate another person or organization;
g) use SPAM or any other inappropriate, defamatory, or illegal information dissemination or gathering practice to promote any CONTENT posted on the PLATFORM;
h) inappropriately or without authorization use the Octuspay trademark in ads and communications;
i) promote SPAM-type disclosures to a generic contact list or repeatedly forward messages or comments to undefined groups without their consent;
j) make publications and advertisements of products that improperly use the Octuspay trademark, promoting confusion among third parties, leading to the belief that the mentioned publications are authorized by Octuspay;
k) promote campaigns and advertisements with unscrupulous and illegal promises to gain undue advantage;
l) make disclosures that offer, as the sole and primary benefit in the purchase of a specific product, the opportunity to become an Affiliate to it.

17. INTERRUPTION, SUSPENSION, AND CANCELLATION OF SERVICES

17.1 The User acknowledges that, due to technical, legal, and/or operational problems, Octuspay may interrupt the provision of any service at any time without prior notice.

17.2 At its discretion, Octuspay may suspend the user's registration on its sites or any service at any time without prior notice.

17.2.1 In the event of suspension, Octuspay will notify the user of the suspension and may take up to 15 (fifteen) business days to analyze the occurrence that led to the suspension.

17.3 After the occurrence that led to the User's suspension is concluded, Octuspay may cancel any user's access to its sites or any service at any time without prior notice.

17.4 Octuspay is not responsible for any damages resulting from the use of its services, except when explicitly stated otherwise.

17.5 Users should create their own backups and backup copies unless otherwise stated.

17.6 Users understand that online activities may involve interruptions and occasional performance or security failures. Therefore, Octuspay cannot be held responsible for failures resulting from technical errors, security breaches, or third-party invasions.

17.7 Access to the octuspay.com platform represents the express and unrestricted acceptance of the terms of use described above.

18. TOOLS AND FEATURES AVAILABLE ON THE OCTUSPAY PLATFORM FOR PAYMENT SOLUTION

18.1 The User acknowledges that Octuspay may establish limits and conditions for the use of tools and features available on the Octuspay platform.

18.2 Octuspay may also change and adjust the available features and tools at any time, at its discretion.

18.3 The User acknowledges that Octuspay may charge fees for the use of certain features and tools and agrees to pay such fees if the user decides to use these tools and features.

18.4 The User acknowledges that the features and tools available on the Octuspay platform may be subject to specific terms and conditions that the user must agree to before using them.

19. PREVENTION OF ILLEGAL ACTIVITIES

19.1 Octuspay may establish general rules to prevent illegal activities or practices on the PLATFORM.

19.2 Octuspay has no obligation to monitor the behavior of its USERS in relation to their use of the PLATFORM, nor to verify or modify the CONTENT, or to provide or guarantee that the USERS will comply with the provisions of these Terms of Use. However, Octuspay may decide to do so at its discretion.

19.3 Octuspay may monitor and examine the behavior of its USERS in relation to the use of the PLATFORM, such as the analysis of publications, comments, and reviews, in addition to collecting data and user identification elements when there are complaints or reports of illegal or inappropriate behavior, or even due to legal requirements or the need to guarantee compliance with the terms of use of the PLATFORM.

19.4 In the event that any USER is found to be violating the rules and regulations set forth herein, or if Octuspay believes that any action or behavior is harming the integrity and reputation of the PLATFORM, Octuspay may take appropriate measures, including suspension of the account and removal of CONTENT.

19.5 If the User has knowledge of any abuse, or has any evidence that any USER of the PLATFORM is violating any of the rules or violating the law, the User may inform Octuspay by clicking on the "Report" button.

20. PRIVACY POLICY

20.1 Any personal data you provide to us, as well as other information about you, is subject to our Privacy Policy, which is incorporated by reference into these Terms of Use.

20.2 You acknowledge and agree that Octuspay may collect and use your data in accordance with our Privacy Policy.

20.3 You acknowledge and agree that it is your responsibility to review our Privacy Policy periodically and be aware of any modifications.

20.4 If you do not agree to the Privacy Policy, you should not use the services provided by Octuspay.

21. DISCLAIMER OF WARRANTIES

21.1 Octuspay, to the fullest extent permitted by law, disclaims all warranties, express or implied, regarding its services and the content provided by it.

21.2 Octuspay makes no warranties or representations regarding the accuracy or completeness of any content, and it is not responsible for (i) any errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our services, (iii) any unauthorized access to or use of our servers and/or any personal information stored in them, (iv) any interruption or cessation of transmission to or from our services, (v) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party, and/or (vi) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the services.

21.3 Octuspay does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through our services or any hyperlinked services or featured in any banner or other advertising, and Octuspay will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services.

21.4 You acknowledge that any reliance on the material and/or content made available by Octuspay is at your own risk.

22. LIMITATION OF LIABILITY

22.1 To the fullest extent permitted by law, Octuspay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use our services, (ii) any unauthorized access to or use of our servers and/or any personal information stored in them, (iii) any interruption or cessation of transmission to or from our services, (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party, and/or (v) any errors or omissions in any content, whether or not Octuspay has been advised of the possibility of such damages.

22.2 You agree that Octuspay is not responsible for any conduct of any USER and shall not be liable to you or any other person for any claims or demands, including claims for damages (direct and indirect), or any other claims or demands that may arise or are related to any dispute with any other user, advertiser, or third party.

22.3 Octuspay's total liability to you for any claim arising from or related to these Terms of Use or our services is limited, to the extent permitted by law, to the greater of (i) the amount paid, if any, by you to Octuspay for the services provided via our platform, or (ii) the amount of money you have spent on our platform in the last six (6) months, unless otherwise provided by applicable law.

22.4 The limitations on damages set forth above are fundamental elements of the basis of the agreement between Octuspay and you.

23. APPLICABLE LAW AND JURISDICTION

23.1 These Terms of Use are governed by and construed in accordance with the laws of the United States.

23.2 You agree to submit to the exclusive jurisdiction of the courts located within the United States to resolve any legal matter arising from these Terms of Use.

23.3 Notwithstanding this, you agree that Octuspay may apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.

24. CHANGES TO THESE TERMS OF USE

24.1 Octuspay may change these Terms of Use from time to time.

24.2 You agree that if you do not agree with any changes to these Terms of Use, you will stop using our services.

25.5 YOU AND OCTUSPAY AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

25.6 These Terms of Use and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Octuspay without restriction. Any assignment attempted to be made in violation of these Terms of Use shall be void.

25.7 A printed version of these Terms of Use and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms of Use to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

25.8 You and Octuspay agree that you may only bring claims against Octuspay on an individual basis and not as a plaintiff or class member in any purported class or representative action or proceeding. Unless both you and Octuspay agree otherwise, the arbitrator may not consolidate or join more than one person's or party's claims and may not otherwise preside over any form of a consolidated, representative, or class proceeding. Also, the arbitrator may award relief (including monetary, injunctive, and declaratory relief) only in favor of the individual party seeking relief and only to the extent necessary to provide relief necessitated by that party's individual claim. Any relief awarded cannot affect other Octuspay users.
